Commercial real estate brokers routinely handle sensitive personal data — from tenant financials to background checks — often without realizing the legal and reputational risks involved. This course gives CRE professionals a practical, field-specific understanding of privacy law and risk management, covering how data moves through a transaction, which federal and Washington State laws apply, and how to build simple safeguards into everyday broker workflows.

By the end of this course, participants will be able to:

1. Identify the types of personal data brokers routinely handle and understand how that data moves through the CRE transaction lifecycle.
2. Recognize the privacy laws that apply to CRE activities, including relevant federal statutes and Washington State's privacy and data breach requirements.
3. Evaluate contractual and regulatory privacy risks, including obligations found in NDAs, service contracts, and potential litigation exposure.
4. Apply privacy-by-design principles to everyday broker activities such as marketing, listings, and email communications.
5. Implement practical safeguards and response protocols, using a compliance checklist and firm-level policies to prevent and manage privacy incidents.

James focuses his practice on the areas of health law, civil litigation, and data privacy. James’s data privacy practice entails advising clients on implementing privacy programs in the context of clinical operations and research, including creating policies and procedures, drafting and negotiating data processing agreements, and conducting privacy impact assessments. In addition to his legal training, James holds a degree in computer science, enabling him to serve as a bridge between legal-compliance and engineering teams on data privacy, governance, and cybersecurity matters.
